Environmentalism is an extremely topical movement that does not seem to obtain results in the long or short term. In this text I defend that this "failure" of environmentalism is due to the fact that both he and his public operate with an ontology contrary to their own bases. Faced with this, a new ontology is necessary that adapts to these. That is why I will show, through Graham Harman, that speculative realism is this new ontology capable of providing environmentalism (...) with what it needs to be effective. (shrink)

La renta básica se nos presenta en la obra de Philippe van Parijs como una propuesta política filosóficamente argumentada, de modo tal que convencerá tanto al teórico de la justicia como al ciudadano que votará su implantación. En este artículo analizamos la argumentación de van Parijs mostrando cómo la efectividad política de sus tesis sólo se sostiene a costa de reducir el debate sobre la renta básica a los términos de su propia concepción de la ética. Ponemos en duda, por (...) nuestra parte, el alcance de esta reducción sobre un doble plano: diluye por completo la dimensión prudencial de toda argumentación política, y no deja más alternativa que la educación sentimental para quienes no se dejen convencer por el equilibrio reflexivo. Este artículo estudia la justificación normativa de la adopción de los ensayos clínicos aleatorizados por parte de las autoridades sanitarias británicas como estándar metodológico en 1946. A partir de un análisis de los distintos intereses de los participantes en el proceso (pacientes, médicos, farmacéuticas y el propio Estado) argumentamos que la aleatorización se adoptó como mecanismo de asignación imparcial de tratamientos, aunque sus propiedades estadísticas no fueran bien comprendidas. Tal justificación permanece aún vigente.

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. This paper continues the defense of a version of scientific realism, Tautological Scientific Realism, that rests on the claim that, excluding some areas of fundamental physics about which doubts are entirely justified, many areas of contemporary science cannot be coherently imagined to be false other than via postulation of radically skeptical scenarios, which are not relevant to the realism debate in philosophy of science. In this paper we discuss, specifically, the threats of meaning change and reference failure associated with the (...) Kuhnian tradition, which depend on a descriptivist approach to meaning, and we argue that descriptivism is not the right account of the meaning and reference of theoretical terms. We suggest that an account along the lines of the causal-historical theory of reference provides a more faithful picture of how terms for unobservable theoretical entities and properties come to refer; we argue that this picture works particularly well for TSR. In the last section we discuss how our account raises concerns specifically for perspectival forms of scientific realism. (shrink)

Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

Some Comments on de Melo-Martin and Harris.

In this paper, we analyze the origin of the links between global bioethics (which we differentiate from biomedical bioethics) and human rights. We understand that we are in a global civilizational crisis, whose roots extend to 1492 today, in which the modern-capitalist model used the discourse of human rights to justify its predatory technocracy. There are three theoretical assumptions that support our analysis: 1) The current conditions in which the technique shows its destructive power over nature (Anthropocene) indicate that none (...) of the ethical antecedents are applicable to such circumstances. In this new context, the kantian categorical imperative has been reconverted into a moral and political duty to not instrumentalize either human beings or nature. We call this new ethical consideration bioethics. 2) The current geopolitical composition of the world must be thought in terms of the global North and the global South, as two regions that are forged in the midst of important processes of globalization of the world-system, and whose main consequence lies in the absence of equity in the distribution of wealth and well-being between the two. 3) The current environmental crisis or climate change, the product of an economic model based on extractive technology, has become one of the most serious threats against human rights. In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. This study uses new arguments to reinvestigate the relation between aesthetics and politics in the contemporary debates on democratic theory and radical democracy. -/- First, Carl Schmitt and Claude Lefort help delineate the contours of an aesthetico-political understanding of democracy, which is developed further by studying Merleau-Ponty, Rancière, and Arendt. -/- The ideas of Merleau-Ponty serve to establish a general "ontological" framework that aims to contest the dominant currents in contemporary democratic theory. It is argued that Merleau-Ponty, Arendt, and Rancière (...) share a general understanding of the political as the contingently contested spaces and times of appearances. However, the articulation of their thought leads to reconsider and explore under-theorized as well as controversial dimensions of their work. -/- This search for new connections between the political and the aesthetic thought of Arendt and Merleau-Ponty on one hand and the current widespread interest in Rancière's aesthetic politics on the other make this book a unique study that will appeal to anyone who is interested in political theory and contemporary continental philosophy. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

The purpose of this article is to present the main contributions to peace, democracy, and the philosophy of education in Colombia, made by philosopher Guillermo Hoyos-Vásquez (Medellín, 1935 – Bogotá, 2013). The work of this Colombian philosopher stands out for its important contributions to political philosophy as the vital, supportive, and responsible exercise of thought concerning the public interest. Using Kant’s concept of practical reason, Husserl’s lifeworld [Lebenswelt], and Habermas’s communicative action as starting points, Hoyos-Vásquez succeeded in going beyond these (...) political philosophers by trying to apply their ideas in the midst of the difficult context of corruption, drug trafficking and armed conflict in Colombia over the past five decades. At the same time, Hoyos-Vásquez developed throughout his life a varied public activity as a thinker and educator, belying the myth of the theoretical distance between the philosopher and his/her political present or historical reality. The thought of Guillermo Hoyos-Vásquez, and his public action as an educator, represent a substantial contribution to contemporary political and educational philosophy, maintaining a close connection between theory and practice. En The paradox of Addition and its dissolution (1969), Mario Bunge presenta algunos argumentos para mostrar que la Regla de Adición puede ocasionar paradojas o problemas semánticos. Posteriormente, Margáin (1972) y Robles (1976) mostraron que las afirmaciones de Bunge son insostenibles, al menos desde el punto de vista de la lógica clásica. Aunque estamos de acuerdo con las críticas de Margáin y Robles, no estamos de acuerdo en el diagnóstico del origen del problema y tampoco con la manera en la (...) que se proponen solucionarlo. En esta medida, en este texto mostraremos cómo la Regla de Adición sí trae problemas semánticos que pueden ser planteados desde diferentes perspectivas contemporáneas, como la extensionalidad del condicional, los principios proscriptivos y la validez conexiva. The status of art in Plato's philosophy has always been a difficult problem. As a matter of fact, he even threw the poets out from his ideal state, a passage that has led some interpreters to assess that Plato did not develop a proper philosophy of art. Nevertheless, R. G. Collingwood, wrote an article titled “Plato's Philosophy of Art”. How can it be? What could lead one of the most important aesthetic scholars of the first half of the twentieth century (...) to make this thesis about Plato? To understand Collingwood's position at that time, I will review it in a new light: his own philosophy of art at that moment as it was propounded in Outlines of a Philosophy of Art, a work he published that same year. I will also examine how Collingwood's position changed when he returned to the same subject in 1938, on the publication of The Principles of Art. Finally, I will end this article defending the correctness of Collingwood's earlier interpretation of Plato's position on art. (shrink)

Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

The aim of this paper is to analyze a selection of arguments used by the Argentine Supreme Court to reduce the sentence of individuals convicted of crimes against humanity. The focus will be primarily centered on “Muiña´s case”, in which a lenient outdated ruling was made. The questions that this work will try to answer revolve around the court´s merit in issuing this lenient ruling to Muiña´s case and its justification. First, Muiña´s case is analyzed in depth. Then, a critical (...) analysis about the ruling and a decision concerning the existence of a true justification will be developed. Finally, we will discuss the appropriateness of the Court’s decision in Muiña´s case as opposed to the decision made in “Batalla´s case”, in which a less beneficial law was applied retroactively. Lo es porque hace posible el nacimiento, permanencia y reconocimiento colectivo de las instituciones, así como su iteración y organización en subsistemas.

In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. In 2015 the United Kingdom (UK) became the first nation to legalize egg and zygotic nuclear transfer procedures using mitochondrial replacement techniques (MRTs) to prevent the maternal transmission of serious mitochondrial DNA diseases to offspring. These techniques are a form of human germline genetic modification and can happen intentionally if female embryos are selected during the MRT clinical process, either through sperm selection or preimplantation genetic diagnosis (PGD). In the same year, an MRT was performed by a United States (U.S.)-based (...) physician team. This experiment involved a cross-border effort: the MRT procedure per se was carried out in the US, and the embryo transfer in Mexico. The authors examine the ethics of MRTs from the standpoint of genetic relatedness and gender implications, in places that lack adequate laws and regulation regarding assisted reproduction. Then, we briefly examine whether MRTs can be justified as a reproductive option in the US and Mexico, after reassessing their legalization in the UK. We contend that morally inadequate and ineffective regulations regarding egg donation, PGD, and germline genetic modifications jeopardize the ethical acceptability of the implementation of MRTs, suggesting that MRTs are currently difficult to justify in the US and Mexico. In addition to relevant regulation, the initiation and appropriate use of MRTs in a country require a child-centered follow-up policy and more evidence for its safety. (shrink)

La Multiversidad Mundo Real “Edgar Morin” asume la misión de una enseñanza educativa basada en los postulados del Pensamiento Complejo de Edgar Morin; pero aún quedan pendientes nuevas definiciones que rompan con los esquemas de la educación basada en el paradigma simplificador. La meta es emprender el gran (...) viraje que haga posible que la reforma paradigmática implique también una reforma de las mentes y del lenguaje, porque nombrar lo nuevo con la palabra vieja dificulta a nivel inconsciente detonar el cambio. Superar los bloqueos propios y los adquiridos por la educación que nos ha conducido a ser individuos desarticulados del contexto, ese es el gran reto de la Multiversidad. (shrink)

En aras del universalismo y en contra del totalitarismo, la ética discursiva ha mostrado con Jürgen Habermas un déficit práctico al negar a la filosofía moral la posibilidad de reflexionar sobre las condiciones alienantes del diálogo desde un ethos concreto. Este artículo analiza el modo en que la teoría de la resonancia formulada por Hartmut Rosa permite revitalizar el debate sobre las condiciones que pueden minar las bases para el diálogo en las sociedades aceleradas sin apoyarse en el concepto de (...) ethos, sino en el de modo de relacionarse con el mundo [Modus der Weltbeziehung]. Con su teoría crítica de la resonancia, Hartmut Rosa ha propuesto las bases de un modelo para evaluar normativamente y afrontar en la práctica las consecuencias de la aceleración social y su inherente tendencia al crecimiento y la innovación. Dicho modelo ha supuesto una bocanada de aire fresco en la Teoría Crítica para reflexionar sobre una dinámica que atraviesa la práctica totalidad de las actividades sociales. No obstante, también ha sido asociado a determinadas características que podrían hacerlo merecedor de dos (...) calificativos siempre reprobados por la Teoría Crítica: el paternalismo y el totalitarismo. Con el fin de contribuir a los debates suscitados por el trabajo de Rosa, la pretensión de este artículo es mostrar el modo en que su planteamiento pretende sortear esas acusaciones al apoyarse especialmente en el concepto de Weltbeziehung [relaciones con el mundo]. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

To explain the evolutionary emergence of uniquely human skills and motivations for cooperation, Tomasello et al. (2012, in Current Anthropology 53(6):673–92) proposed the interdependence hypothesis. The key adaptive context in this account was the obligate collaborative foraging of early human adults. Hawkes (2014, in Human Nature 25(1):28–48), following Hrdy (Mothers and Others, Harvard University Press, 2009), provided an alternative account for the emergence of uniquely human cooperative skills in which the key was early human infants’ attempts to solicit care and (...) attention from adults in a cooperative breeding context. Here we attempt to reconcile these two accounts. Our composite account accepts Hrdy’s and Hawkes’s contention that the extremely early emergence of human infants’ cooperative skills suggests an important role for cooperative breeding as adaptive context, perhaps in early Homo. But our account also insists that human cooperation goes well beyond these nascent skills to include such things as the communicative and cultural conventions, norms, and institutions created by later Homo and early modern humans to deal with adult problems of social coordination. As part of this account we hypothesize how each of the main stages of human ontogeny (infancy, childhood, adolescence) was transformed during evolution both by infants’ cooperative skills “migrating up” in age and by adults’ cooperative skills “migrating down” in age. ENGLISH Blumenbergs Metaphorology is offered as an hermeneutical alternative to heideggerian existential hermeneutic. It implies that philosophical anthropology –as we find her in Gehlen, Plessner and others– achieves onthological standing, and it’s developed as a history of great metaphers, that seems to support the history of ideas.

Comment l’oeuvre de Dewey nous aide-t-elle à rendre compte du potentiel de démocratisation des luttes sociales, tout en mettant l’accent sur leurs activités d’enquête* ? Au-delà des approches délibératives, une approche deweyenne montre comment les mobilisations collectives, qui visent à produire des « cadres d’injustice » et à promouvoir des « relations justes », ont le potentiel d’approfondir la pratique démocratique. Mon argumentation s’organise en trois temps. Tout d’abord, elle montre comment, pour Dewey, les « pratiques épistémiques » – d’identification, (...) de définition et de résolution de problèmes sociaux – conduisent au changement des normes de participation et d’inclusion de façon extensive et intensive. Ensuite, elle examine la manière dont le modèle expérimentaliste de Dewey médiatise l’approfondissement de la démocratie et la lutte pour la justice : le besoin d’intégrer le maximum de perspectives et de les rendre compatibles les unes avec les autres que l’on éprouve la nécessité d’explorer les normes hégémoniques de la pratique politique. Enfin, elle identifie des éléments d’expérimentalisme démocratique dans trois pratiques d’enquête : « consciousness-rising », « testimonio » et « conricerca », et tente de montrer leur potentiel de changement de notre compréhension de la pratique politique. En la literatura jurídico penal, el arrepentimiento cobra relevancia en un lugar específico: la condena, más precisamente, en la determinación de la pena del sujeto que ha sido encontrado responsable por la comisión de un delito y que, a su vez, se encuentra arrepentido por su accionar. [No hay resumen disponible, se incluyen los primerso párrafos del texto] Hace ya mucho tiempo algunos amigos de alrededor de treinta años comenzamos a estudiar filosofía bajo la dirección de Gregorio Klimovsky. Muy pronto uno de nosotros se destacó por su capacidad creadora y su curiosidad filosófica: era Juan Larreta. Es así que, a pesar de haber iniciado tarde su formación, descolló como filósofo de mérito tanto en la Argentina como en el exterior. Presidente de la Sociedad Argentina de Análisis (...) Filosófico (SADAF) durante dos períodos, obtuvo el Diploma al M érito en Filosofía de la Fundación Konex en el 2006 y fue nombrado miembro honorario de la Sociedad Española de Filosofía Analítica (SEFA) en 2010. Organizó seminarios y dictó conferencias en centros de estudios filosóficos y en universidades argentinas y extranjeras, en cuyas publicaciones escribió numerosos artículos de singular valía, todos ellos caracterizados por su originalidad, su irreverente desafío al sentido común y sus ingeniosos experimentos mentales (thought experiments). This paper aims at providing an epistemic defense of democracy based on John Dewey’s idea that democracies do not only find problems and provide solutions to them but they also articulate problems. According to this view, when citizens inquire about collective issues, they also partially shape them. This view contrasts with the standard account of democracy’s epistemic defense, according to which democracy’s is good at tracking and finding solutions that are independent of political will-formation and decision-making. It is also less (...) vulnerable to the criticisms that have been raised against the standard account. To show this, the paper develops a theory of expressive domination and argues that problem-articulation works best when it is inclusive and domination-free. It also shows that democratic conflict represents a fundamental element for problem-articulation. (shrink)

This article argues that populism, both in its left-wing and right-wing versions, is a social pathology in the sense contemporary critical theorists give to it. As such, it suffers from a disconnect between first order political practices and the reflexive grasp of the meaning of those practices. This disconnect is due to populists’ ideal of freedom, which they understand as authentic self-expression of ‘the People’, rejecting the need for mediating instances such as parties, parliaments or epistemic actors. When enacted in (...) political practices and institutions, this ideal creates the conditions for undermining different forms of political freedom, including populist’s own ideal of collective self-expression, which they erode by fostering expressive domination. This all makes populism a self- defeating political ideology and bad candidate for advancing democracy in times of crisis. The article ends with a consideration of the advantages of this view compared to existing approaches to populism. (shrink)

La conformación de las ciencias sociales ha estado cruzada no sólo por la discusión acerca de su estatuto científico y sus criterios metodológicos de demarcación, sino por la concepción de la ciencia y del mundo que le subyacen. A la disputa disciplinar del campo sociológico le precederá la disputa acerca de qué debe entenderse como ciencia y cuál es la concepción del mundo le acompaña. El presente artículo traza un recorrido por el proceso de conformación, construcción y transfiguración de las (...) ciencias sociales en la modernidad y la contemporaneidad, atendiendo a la polémica subyacente en sus preceptos epistémicos. Con su teoría crítica de la resonancia, Hartmut Rosa ha propuesto las bases de un modelo para evaluar normativamente y afrontar en la práctica las consecuencias de la aceleración social y su inherente tendencia al crecimiento y la innovación. Dicho modelo ha supuesto una bocanada de aire fresco en la Teoría Crítica para reflexionar sobre una dinámica que atraviesa la práctica totalidad de las actividades sociales. No obstante, también ha sido asociado a determinadas características que podrían hacerlo merecedor de dos (...) calificativos siempre reprobados por la Teoría Crítica: el paternalismo y el totalitarismo. Con el fin de contribuir a los debates suscitados por el trabajo de Rosa, la pretensión de este artículo es mostrar el modo en que su planteamiento pretende sortear esas acusaciones al apoyarse especialmente en el concepto de Weltbeziehung [relaciones con el mundo]. Una de las manifestaciones más ejemplificadoras del aumento de las velocidades y del cambio social, característico de las sociedades aceleradas, se da en la creación de tendencias laborales basadas en la hibridación entre trabajo y tiempo libre. Proyectadas sobre una idea positiva de la flexibilidad y del autocontrol, mantienen una estrecha relación con niveles altos de autointensificación. Este artículo reconstruye los rasgos básicos de prácticas formalizadas como el bleisure o el workation para caracterizar un fenómeno de la aceleración más específico (...) dentro de esta tendencia, al que denomino “turistificación del trabajo”. Este concepto resalta la atribución específica de rasgos atractivos de la práctica turística al trabajo con fines productivos. Frente a los discursos positivos sobre la movilidad y el turismo asociados a este fenómeno, se sugieren las bases de un modelo de crítica para reconocer sus implicaciones alienantes negativas en relación con la vida buena. The 'critical turn' in tourism studies is defined as a research perspective that explores social transfor- mation in and through tourism by facing the negative impact of strategic-instrumental rationality on this activity. This work explores the features of discourse ethics that may normatively support tourism transformation, a gap that has not been thoroughly discussed in tourism research. For this purpose, the study combines the use of critical and ethical theory with an analysis of discourse ethics in tourism literature to demonstrate (...) that the use of Habermasian discourse ethics needs to be complemented with the Apelian approach. Through these steps the work reveals the theoretical bases of discourse ethics to discuss whether understandings between stakeholders guided by strategic-instrumental rationality can be reached not only in the political sphere —Habermas—, but also in the ethical field —Apel. In support of Descartes’ epistemology, Lex Newman advances the ‘Non-atheistic-knowledge- thesis’, i.e., indefeasible knowledge cannot be gained unless the existence of God is proved. Here I expound the ‘non-atheistic-thesis-of-Cartesian-metaphysics’, which, unlike Newman’s, refers to how four Cartesian metaphysical conclusions require the existence of God. To test whether such conclusions need divine existence, we may ask what would happen if God did not play any decisive role in the Meditations. As I argue, four unpalatable consequences would follow for Cartesian metaphysics, which (...) would ruin Descartes’ plan to refute the skeptic and the atheist alike. (shrink)

With his critical theory of resonance, Hartmut Rosa has proposed the basis of a model for normatively criticizing and practically addressing the consequences of social acceleration, and its inherent tendency towards growth and innovation. This model has brought a fresh perspective to Critical Theory, offering a framework to examine a dynamic that permeates virtually all social activities. However, it has also been associated with certain characteristics that could potentially justify two labels always reproached by Critical Theory: paternalism and totalitarianism. To (...) contribute to the ongoing debates sparked by Rosa's work, this article aims to demonstrate how Rosa's approach actively seeks to avoid these accusations, primarily by incorporating the concept of Weltbeziehung [relationships with the world]. Se le llama ‘psiquiatría biológica’ a la vertiente de la investigación psiquiátrica que busca establecer asociaciones estables entre condiciones psiquiátricas y factores biológicos específicos. La búsqueda de tales asociaciones está motivada por lo que llamo el “compromiso causal” de la psiquiatría biológica, que es la presunción de que factores biológicos específicos son las causas principales de las condiciones psiquiátricas. En este artículo argüiré que dicho compromiso es una presunción implausible sobre esas condiciones, pues la mejor evidencia psiquiátrico-biológica disponible no lo (...) respalda y es dudoso que la evidencia futura lo hará.
